The appeal case referred to in para. 8 of my last Report has not yet finally decided, the case having been referred back by the Supreme Court to the Magistrate for further investigation.

No Retail Licences under Sec. 44 of the Opium Ordinance 1887 have yet been applied for. I have enquired and ascertained that three of the Retail shops formerly in this Colony have removed to Chinese Kowloon and six to Canton. These dealers buy whole chests in this Colony which, after paying duty to the Chinese Customs, they convey to their shops, and sell by retail. In addition to the retail shops there are shops in Chinese Kowloon which boil opium; and it is suspected that some of the opium boiled there are surreptitiously brought into the Colony to the detriment of the Opium Farmers.
Notwithstanding the heavy duty abroad paid to the Chinese Government, Opium brought into the Colony is readily disposed of, owing to its adulteration the importers can sell at a much reduced rate to that charged by the Opium Farmers. In addition to bringing adulterated prepared Opium into the Colony, there is reason to believe that Opium purchased from the retail dealers in Kowloon is brought by persons into the Colony, and surreptitiously, both boiled in the Colony, and disposed of in the Colony, the adulteration of the drug recouping the people who do so for the extra charge by way of duty already levied upon it by the Chinese Customs.
In case No: 8446 referred to in the above-schedule, the Opium was purchased from one of the Retail dealers in Kowloon.
